These Terms & Conditions govern your use of the Muhika website and your purchase of products and services from Muhika.

By using our website, making an enquiry, placing an order or purchasing products from Muhika, you acknowledge that you have read and understood these Terms & Conditions and agree to be bound by them, subject to any rights that cannot legally be excluded under Kenyan law.

Muhika is an African fashion and textile brand based in Nairobi, Kenya.

Our products may include clothing, fabrics and other fashion and textile products offered from time to time.

An order constitutes a request to purchase products subject to product availability, payment confirmation and acceptance by Muhika.

Muhika reserves the right to decline or cancel an order where reasonably necessary, including where:

A product is unavailable;
There is an obvious pricing or description error;
Information provided by the customer is materially incorrect;
A transaction appears fraudulent or unauthorised; or
Other legitimate business or legal reasons require cancellation.

Where a payment has already been received for an order that Muhika cannot fulfil, the appropriate remedy will be determined in accordance with applicable law and the circumstances of the transaction.

Payment must be completed through the payment method or arrangement agreed with Muhika.

An order may not be processed or dispatched until payment has been appropriately confirmed, unless a different arrangement has been agreed.

10. Fabric Purchases

Fabric purchases are subject to our Returns & Refunds Policy.

Unless otherwise required by applicable law or where Muhika has supplied a materially incorrect or defective product:

fabric sales are final and cannot be returned or exchanged.

Customers are encouraged to inspect and confirm their fabric selection before completing their purchase.

11. Sale and Promotional Products

Sale and promotional products may be offered under specific terms communicated at the time of purchase.

Unless otherwise required by applicable law, sale purchases are not eligible for refunds.

Where permitted under our Returns & Refunds Policy, a clothing item may be exchanged for the same design in a different available size.

12. Wholesale & Trade Purchases

Wholesale and trade transactions may be subject to terms agreed specifically between Muhika and the buyer.

Wholesale customers are responsible for confirming:

Products and designs;
Quantities;
Sizes;
Colours and patterns;
Delivery arrangements;
Pricing;
Payment arrangements; and

Unless otherwise required by applicable law or where Muhika has supplied an incorrect or materially defective order:

wholesale sales are final and are not eligible for return, exchange or refund.

Where specific commercial terms have been agreed for a wholesale transaction, those terms will apply to that transaction.

13. Custom and Special Orders

Some products may be made, altered or sourced specifically according to a customer’s requirements.

Custom or special orders may be subject to specific terms communicated before the order is confirmed.

Because such products may have been prepared specifically for the customer, they may not be eligible for cancellation, return, exchange or refund except where required by applicable law or where the product is defective or materially different from the agreed specifications.
